GRANDFATHER CLAUSE (Petition) HOW THIS PETITION CAME TO BE: Some seven or so Years ago this museum curator noticed some old Medical Cannabis bottle pictures on a website of interest to museum members. Naturally, I sent a short e-mail to the site asking for permission to reproduce the pictures. As it turned out, not only was permission granted, but I also received a personal invitation to go and visit with Dr. Tod Mikuriya, who at that time had long ago become a legend within the pro-Medical Cannabis movement. It was during that initial meeting that the subject of his original F.D.A.[1] [grandfathering clause] petition came up. And thus, I quickly understood Dr. Mikuriya’s reasons for inviting me over. The F.D.A. had just the year before rejected his own FDA grandfathering clause petition for various technical (some would say, ridiculous) issues. It seemed obvious that the D.E.A [2] had somehow highjacked the whole approval/rejection process. But be that as it may, Dr. Mikuriya wanted to re-file the petition AND wanted the museums help in addressing the F.D.A.’s technical reasons for rejection. I personally promised him that we would do what we could, and as time went on, I also (personally) promised that the petition, come-hell-or-high-water, would be re-filed. In the end, it was a lot of work (over seven years in fact), but it was well worth it. The only thing that I regret is that the late Dr. Mikuriya would not be with us during the physical re-filing.
WARNING: ------ No one here is kidding themselves that full F.D.A. approval is going to happen - just like that. The forces that are aligned against us are very powerful and very determined to maintain their status quo. But then on the other hand, we’ve noticed that every time our enemies are forced to defend themselves against these kind of legal challenges, they usually are forced to expose their hypocrisy. [3] In effect, they are forced to use legal arguments that makes them look like fools to anyone hearing them. [NOTE: - a web page, has already been allocated for the expected F.D.A. rejection letter. Let’s see what their excuses for not approving Medical Cannabis are this time.] This petition is dedicated to the memory of the late Dr. Tod Mikuriya, -- he will not be forgotten. Tod H.
